Introduction to Laws & Regulations

The Board of Directors is empowered to govern Ternbridge in accordance with its by-laws and the regulations of the Association. However it is a bit more complex than this simple statement.

Ternbridge is one of nine communities, which are members of Terramar, the "master association" and the by-laws and regulations of Terramar also apply to our community. In addition we must comply with the laws of the City of Parkland, Broward County and the State of Florida. There are still other agencies who impact decisions we make in Ternbridge, among these are the South Florida Water Management District and of course the Federal Government.

Most of these agencies can have regulations on the same item and it is generally the most restrictive regulation that takes precedent. For example if Ternbridge allows a particular item in our regulations but that same item is prohibited in the Terramar documents, then we are bound by the Terramar regulation.

The purpose of this section in our web site is to make our residents aware of some of the more common items that affect our daily life. In this section we will highlight some regulations and refer you to the sections of the regulations that seem to govern.

Disclaimer: This section is not intended to replace the formal documents, which we all have in our possession, or to make statements or opinions regarding all or any of these different regulations. These items are placed here, only for the convenience of the residents and any disputes or different interpretation should be directed to the Ternbridge Board. We trust that this section is found of interest and helpful to the community.


Terramar

DECLARATION OF RESTRICTIONS AND PROTECTIVE COVENANTS
FOR TERNBRIDGE
ARTICLE VIII. OWNERSHIP IN TERRAMAR

Section 1. Page 23: Ownership in Terramar.

By taking title to a Lot, each owner becomes subject to the terms and conditions of the Declaration of Covenants, Conditions and Restrictions for Terramar. Among other things, that document provides that an Owner shall become a Member of the Terramar Community Association, Inc., the master Association at Terramar; shall acquire certain property rights to Common Areas within Terramar; shall become subject to the assessment of the Terramar Community Association, Inc., which assessments, except special assessments, may be collected by Ternbridge Homeowners' Association upon the request of the Terramar Community Association, Inc.


Dogs in Ternbridge.

Commentary: Pets of all types are an integral part of our life-style and dogs are very popular as a companion for young and old alike. There are however specific regulations that we must follow if we own a dog in this community. Some of these are obviously "the right thing to do" while others are the law. In this section we publish the regulations regarding dogs but we hope that all dog owners will choose "the right thing to do" and respect the rights of others when exercising their pets.

The following is the exact wording from the documents:

ARTICLE VII. GENERAL RESTRICTIVE COVENANTS

Section 10. Page 20: Pets, Livestock & Poultry.

No animals, livestock, or poultry of any kind shall be raised, bred or kept on any Lots except that dogs, cats, or other household pets may be kept, but no more that a total of two (2); provided, however, those pets which are permitted to roam free, or in the sole discretion of the Association, endanger the health, make objectionable noise, or constitute a nuisance or inconvenience to the Owners of other Units or the Owner of any property located adjacent to the Properties, may be expelled and removed from the Properties by the Board. No pets shall be kept, bred or maintained for any commercial purpose. Dogs which are household pets shall be confined to a leash whenever they are outside a Lot.

ARTICLE XIII USE RESTRICTIONS

Section 4. Page 25: Animals and Pets.

No animals, livestock, or poultry of any kind may be raised, bred or kept or permitted on any Unit, with the exception of dogs, cats, or other usual and common household pets but no more that a total of two on any one Unit. The keeping of a dog or other domestic pet is not a right of an Owner but is a conditional license. This conditional license is subject to termination at any time by the Board of Directors upon finding that a dog or other pet, is vicious, is annoying to other residents, or has in any other way become a nuisance. The Owner of a pet assumes the liability for all damage to persons or property caused by the pet or resulting from its presence at the properties.

This license is subject to the following conditions:

A. Pets shall be kept on a leash or within a fenced area of a yard at all times when outside the Unit.

B. Pets are permitted to have excrements upon the Common Areas provided that the Owner shall immediately remove such excrements from the Common Areas with a "Pooper-Scooper" or other appropriate tool and deposit said waste in an approved trash receptacle.

C. The Owner of a pet shall be responsible, and by virtue of ownership, assumes responsibility for any damage to persons or property caused by his pet(s).

D. Any pet who's Owner violates the provisions and intent of this Rule shall be deemed a nuisance in accordance with Section 5 of this Article and subject to removal in accordance with the provisions of the Declaration


Home Modifications and Painting.

Commentary: All residents should be aware that the Association must approve, in writing ANY modification contemplated by a resident prior to commencing the modification. This includes painting or adding or removing anything to the exterior of the home.

Two sections of our documents refer to this situation and since the Terramar section is very lengthy, we will only reproduce a portion of this section for your information. Each resident is urged to read the entire documents and to contact the Board of Directors for approval or comment, before undertaking any exterior or interior modification.

ARTICLE IV ARCHITECTURAL CONTROL BOARD

Section 2. Page 9. Owner to Obtain Approval.

No Owner shall make, install, place, or remove any building, fence, screen enclosure, porch, wall, patio area, pool, spa, landscaping or any other alteration, addition, improvement, or change of any kind or nature to, in or upon any portion of the Common Areas or the Owner's Lot, unless the Owner first obtains the written approval of the Association for same, except that such approval shall not be required for any maintenance or repair which does not result in a material change in any improvement including the color of same.

ARTICLE XII ARCHITECTURAL STANDARDS.

Section 2. Page 24. Modifications Committee (Lines 5 through 10) Partial quote of this section.

No permission or approval shall be required to repaint in accordance with an originally approved color scheme, or to rebuild in accordance with originally approved plans and specifications. Nothing contained herein shall be construed to limit the right of an Owner to re-model the interior of his Unit, or to paint the interior of his Unit any color desired.


Mail Boxes

Commentary: The following item is part of the Ternbridge documents and outlines the method by which the standard for our mailboxes was originally selected. The mailboxes used in Ternbridge are of a common design and color and owners can't change the design or the color unless they get first approval in accordance with Section 2. Item 20. Mailboxes and Newspaper Delivery Boxes

Each Lot on which a residence has been completed as evidenced by issuance of a certificate of occupancy shall have upon it a mailbox. The sign, design, quality and appearance of the mailbox and newspaper delivery box, if any, shall be approved by the ACB. In the event the U.S. Postal service makes available delivery service of mail to individual dwellings located on Lots, the ACB may require that all mailboxes, newspaper delivery boxes or other such receptacles previously utilized by Owners be attached to dwellings in a form and manner approved for use in the subdivision and all lots shall use the standard mail box.


Miscellaneous Rules

EXHIBIT "C"
DECLARATION OF RESTRICTIONS AND PROTECTIVE COVENANTS
FOR TERNBRIDGE

1. Any owner who desires to construct an improvement or structure of any kind on his Lot shall submit four (4) complete sets of signed and sealed plans and specifications and samples of proposed building materials to the Architectural Control Board (the "Board").
2. All approvals by the Board shall be subject to further approval by Terramar Community Association, Inc.
3. The exteriors shall be consistent with the theme adopted by the Developer.
4. No metal chain link fences are permitted. All walls shall be concrete block and stucco.
5. The following plant material shall not be planted in the properties: a) Cocos Nucifera (coconut palm); b) Melaleuca Leucadendron (cajeput tree); c) Schinus Terebinthilolius (Brazilian Pepper); e) Wedalia Trilobata (Wedalia); and f) Acacia.
6. Except when placed in front of pick-up, no garbage container shall be visible from any street.
